The domain name ‘www.triokart.com’ (hereafter referred to as “website”) is owned by Lawpoint Educationals, a proprietorship concern, registered under the Kolkata Municipal Laws. The registered office of Lawpoint Educationals is situated at Stephen House, 6C, R.N.Mukherjee Road, Ground Floor, Kolkata – 700001, West Bengal, India.

You are requested to go through the Terms and Conditions carefully while immediate use or future use of services offered by www.triokart.com. While using the website or availing the services offered by the website you agree to abide by the Terms and Conditions of website. Whenever the terms “You” or “User” is used it shall mean any natural or legal person who has agreed to become a buyer or customer on the website.

The website is only available for use to persons who can form legally binding contracts. Persons who are incompetent within the meaning of the Indian Contract Act,1872 including un-discharged insolvents, etc. are not eligible to use the site. Terms and Conditions for Purchases

Once you place an order for the displayed items/products or services we accept your offer by providing a confirmation to you by e-mail and/or mobile/telephonic communication confirming your offer. We shall accept each such offer by you only if you expressly subject to and conditioned on your assent to these terms and conditions of sale mentioned herein below. No other terms and conditions will apply.

Communication in Electronic Mode

When you visit www.triokart.com or when you send email to us, it implies that you are communicating with us in electronic mode. When you communicate with us you accept to receive communication from us in electronic mode. We will do all communications with you by email or by posting notices on our website. You also assent to all agreements, notices, disclosures, and other communications that we provide to you in electronic mode, satisfies all legal requirement if such communication is in writing.

Price Changes

Prices of any item/product or service displayed on the website are indicational and are subject to change without prior notice. Taxes or charges may be charged separately in case of certain items/products or services wherever applicable. Such additional taxes or charges shall be mentioned on the website.

Payments

All items/products or services shall be shipped only after receipt of complete payment for the items/products or services. We accept payments by cheque/cash/draft, net-banking, credit card, debit card, cash card, mobile payments.

Shipping and Handling

All products are shipped by www.triokart.com exclusively. It is our responsibility to get the product shipped in time. The shipping time mentioned on www.triokart.com is only estimated time but not guaranteed time. We shall not be liable for any delays in the shipments. Once the items/products or services are delivered the title and risk of loss is transferred to you. In case you want to return any items/products or services then you need to send it to us by any courier services available with you, this reverse shipment is not possible from our end due to lack of logistics partners.

Returns and Replacement

All items/products or services are accepted return if the items/products or services are damaged during transit, defective, wrongly delivered, wrong product, incomplete package etc., subject to the condition that such information is received by us within 48 hours from the date of receipt of the item/product or service and such item/product or service should be returned in their original condition.
Any items/products or services purchased from www.triokart.com can be easily replaced under certain conditions as mentioned below. Customers need to inform us about any damage or defect within 48 hours from the date of receipt of the item/product or service. Where a customer fails to inform us within the stipulated time provided, i.e. within 48 hours from the date of receipt of the item/product or service, in such a case Lawpoint reserves the right to accept or reject such request at its own discretion. Lawpoint shall replace the product at a nominal cost or at no cost. Such cost shall be decided by Lawpoint.
Lawpoint strives to replace the item/product or service with a brand new item/product or service. However, if such item/product or service is out of stock Lawpoint reserves the right to provide an alternate item/product or service in exchange.
The replacement guarantee is only valid if there are manufacturing defects and transit damages. Replacement guarantee is invalid in case of damages due to wear and tear and negligence on part of customer.

  • Softwares and its Utitlity Products
  • Books with CDs
  • E-Journal Subscriptions

Cancellations, Exchanges and Refunds

Any sort of changes to orders regarding changes to quantity addition or deletion, specification changes or any other change shall be reflected in the order details. All sales made are made on a full and final basis, but any changes in quantity or cancellations can be made before the order is shipped. Lawpoint reserves the right to cancel any order accepted by us before shipment if there is any problem in the payment mode selected by you or if the credit department does not approve your credit.
Lawpoint reserves the right to cancel any order if there is any discrepancy with the pricing of the item/product or service or any other reason even if the payment is received in full. In such a case a full 100% refund of the payment by the customer shall be made. The information for the same shall be provided to the customer.
In case you cancel any order post procurement, but before it is shipped by triokart.com, then triokart.com will charge restocking fee applicable as per product category. All International books shall attract a restocking fee of 40% of the order value. All other orders will attract a restocking fee of 25% of the order value. Refund for the order shall be made within 15 working days after deduction of the restocking fee.

My Account

Any information provided by a customer in registration, buying or listing process or in feedback area or through email feature is contained in My Account. We protect the information provided to us or on our website according to our Privacy Policy. Every customer is required to maintain the confidentiality of its account and password and for restricting access to its computer, and the customer agrees to take all responsibilities for all the activities that happened in its account or password. Triokart.com shall not be responsible to any person for any loss or damage caused as a result of failure on the part of the user to protect its account or password. If any user comes to know or suspects that anyone else knows its password then he/she should inform us immediately. If Triokart.net has reason to believe that there is a security breach or misuse of the website, then it may on its own require you to change your password. Triokart.com reserves the right to suspend the account of any customer on its own discretion. It is hereby agreed by the user that all information submitted by a customer in the account sign up form or in any other place in the website are true and accurate. It is the duty of the customer to update its data from time to time. If any customer provides any information that is not true, inaccurate, incomplete or if Triokart.com has reasonable grounds to suspect that the information provided by the customer is untrue or inaccurate, not current or not in accordance with the User Agreement, then Triokart.com reserves the right to indefinitely suspend or terminate your membership and refuse to provide access to the website.

Licence and Website Access

General: Triokart.com does grant its customer limited license to access the website and make personal use of the website. However, it does not allow anyone to download (other than available download materials) or to modify it or any portion of it. Further, Triokart.com does not grant any license for any resale or commercial use of this website or its content, any collection or use of any product listing, description or pricing or copying of account information or any use of data mining or any similar data gathering or extraction tools. Gift Voucher

The Gift voucher cannot be exchanged for Cash/Cheque. The Holder of the Gift voucher is deemed to be the beneficiary of such Gift voucher. The amount of Gift voucher cannot be transferred to anyone else except to the one account to which it has been issued to. The Gift voucher cannot be used with any promotional offers on Triokart.com. The Copy of the Gift Voucher shall be emailed to the customer and shall be valid for a period for a period of 1 year from the date of purchase. On request of the customer the Gift voucher can also be emailed to any other email id once the order is processed.

Reviews, Comments, Contents, Communications and Other

Any user may post reviews, comments and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights to otherwise injuries to third party or objectionable and does not consist of or contains software virus, political campaigning, commercial solicitation, mass mailing or any form of spam.
No user shall use false email address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Triokart.com reserves the right (but not the obligation) to remove or edit such content but does not regularly review posted contents.
